Terms of Service

1. Acceptance of Terms

By accessing or using Actiory ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Actiory is an activity storytelling platform that transforms your physical activities (runs, bike rides, hikes, swims, and more) into personalized, shareable narratives. You provide activity details, optionally upload route files and photos, and our system generates a story based on your inputs.

3. Account Registration

You sign in to Actiory using Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Credits & Payments

Actiory operates on a credit-based system. Each story generation consumes credits. Credits can be purchased individually or through a subscription plan.

  • All prices are displayed in your local currency where applicable
  • Credits are non-transferable and have no cash value
  • Unused subscription credits do not roll over to the next billing period
  • We reserve the right to modify pricing with reasonable advance notice

5. Refund Policy

Due to the digital nature of our service, refunds are generally not available once credits have been consumed. If you experience a technical issue that prevents story generation, please contact us within 7 days and we will review your case. Subscription cancellations take effect at the end of the current billing period.

6. Your Content

You retain ownership of all content you submit to Actiory, including activity data, photos, and GPX files. By using the Service, you grant us a limited license to process your content solely for the purpose of generating stories and operating the Service.

We will not use your photos, route data, or personal activity details for advertising or share them with third parties without your explicit consent.

7. Generated Content

Stories generated by Actiory are created based on the inputs you provide. While we strive for accuracy, generated content may contain inaccuracies or creative liberties. You are responsible for reviewing generated stories before sharing them publicly.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or harmful content
  • Attempt to reverse-engineer, decompile, or extract our models or algorithms
  • Use automated tools to access or interact with the Service
  • Resell, sublicense, or redistribute generated content as a standalone product
  • Interfere with or disrupt the Service or its infrastructure

9. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Actiory and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Actiory shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Service Availability

We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. We may temporarily suspend or limit access for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime when possible.

12. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data as described in our Privacy Policy.

13. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Actiory operates, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
